Cannabis Crossroads

Marijuana in Montana is at yet another crossroads.

Last week, the Montana Supreme Court reversed a lower court’s decision which temporarily suspended some of the worst parts of the legislature’s godawful SB423. The Supremes instructed the lower court to revisit the arguments under a different standard of law.

What’s this mean? In the short term, it’s possible that SB423 in its entirety could become the law of the land as early as September 26th: Providers may have only 3 patients, and marijuana must be given away for free, etc. – DPHHS has weighed in with this letter (PDF) about how they’re handling things.  Additional legal proceedings could delay full implementation, which means that voters (that’s YOU) will likely decide SB 423′s fate on November 6th.

Under a heading of IR-124 (the petition that gathered over 35,000 signatures last summer), you’ll be asked to vote FOR/AGAINST SB423.

*My Personal Crossroads*

Since I started Montana NORML in 1998, the landscape of marijuana politics has changed significantly. And so have we all. After fourteen years of leading the organization (and, simultaneously, a high-tech business), the time is right for me to step back and help some new blood to take over. Since I announced back in May that Justin Michels was volunteering to take over leadership, he’s done a great job providing continuity and presence for the organization.

Today, I’m stepping aside and handing Justin the reins. I will still be involved in various transition and guidance roles through the end of the year, and I’ll always support marijuana law reform efforts.

Thank you to everyone who’s joined our mailing list, liked our Facebook page, and followed our Twitter feed. Thank you to everyone who has donated their time and money to the effort. And a special thank you to those of you who have suffered the indignities and stresses of being busted for activities that should not be crimes, and then risen up to fight back with your activism, your vote, your passion.

How to Stop Marijuana Arrests in Montana

With just a few weeks left to go in the CI-110 signature gathering effort, now is the time to act. Now is the time for you (yes, you!) to volunteer a bit of your time to help.

Now is the time to stand up and say, “There is nothing wrong with responsible adult use of marijuana, and it should be of no concern to the government.”

Now is the time to act to end criminal penalties for marijuana.

Now is the time to do something to help put CI-110 on the ballot. If passed, the initiative would create an adult right to “responsibly purchase, consume, produce, and possess marijuana, subject to reasonable limitations, regulations, and taxation.  Except for actions that endanger minors, children, or public safety, no criminal offense or penalty of this state shall apply to such activities.

How you (yes, you!) can help right away:

  1. Volunteer to get ten signatures from friends and family. Everyone knows ten people. If you’re a cannabis consumer, you’ve just
  2. Volunteer to spend one day collecting signatures: June 5th — that’s primary election day, and the campaign needs as many petitioners as possible to help gather signatures at polling places statewide.
  3. Get hired on a temporary basis gathering signatures every day. We particularly need your help in the Flathead Valley and Butte areas, but we need people statewide.
  4. Visit our new website — which includes new ways to share the message with your friends on Facebook and get involved.

We’re hearing some outrageous, heartbreaking, and discouraging news these days. More federal raids. Indictments, convictions, prison sentences and heavy fines (see news stories below). Montana citizens, whose mistake was to believe that careful compliance with state law would protect them from federal law enforcement, are now facing decades in prison.

It’s enough to make an advocate conclude, “the feds have won, we give up.”

I’ve even heard that some people are afraid to sign the petition for CI-110, because they “don’t want to be on a list”.

I get it. After all, just because you’re paranoid doesn’t mean they’re not out to get you. And they’re out to get us, every single one of us.

But there’s strength in numbers, and I’ll tell you, we’ve got the numbers. Around 100,000 people in Montana consume cannabis from time to time. Enough to change any election. Enough to put CI-110 on the ballot.  Enough to win.

But we — you and I — can’t wait for “someone else” to do it.

If everyone reading this collected ten signatures from family and friends, we’d qualify CI-110 for the ballot in no time.

INTERNATIONAL DAY OF ACTION FOR ACTIVISTS: SATURDAY MAY 5 2012

FOURTEENTH ANNUAL GLOBAL CANNABIS MARCH

As they have in years past, local Activists from Missoula will join over three hundred cities worldwide in the fourteenth annual Global Cannabis March. Participants are especially excited for this year’s march because of the momentum building behind their long-held position that marijuana prohibition causes more harm than actual marijuana. 2012 will be a landmark year for marijuana reform activists around the nation. Colorado and Washington state have so far qualified initiatives to legalize and regulate marijuana similar to alcohol.

Montana NORML is coordinating the event to capture support for Montana First, a campaign that is working currently to put a ballot proposal on the November ballot that will protect the rights of adults who use and grow marijuana.

The march is scheduled to begin shortly after 4pm on Saturday May 5th.

Local participants will gather at Jacob’s Island (Bark Park) to march along the Clark Fork River to the Missoula County courthouse and through the downtown streets. The march is scheduled to begin shortly after 4pm. (Facebook event here.)

I put together a free and anonymous one-question survey for caregiver businesses. Click the link to answer, it takes 30 seconds or less.

These have been the most intense weeks of drug policy reform in my 13 year career as a volunteer for Montana NORML. There’s a lot going on, and a lot to cover, so scan the major headings below and read what’s of interest.

Lawsuit News

The MTCIA‘s historic lawsuit (I’m the secretary & treasurer) will be heard in Helena on Monday and Tuesday of next week.   Our side is feeling good about our arguments and I’m optimistic we’ll get some sort of a favorable outcome.  My fellow MTCIA board member Kate penned this overview of what’s happening and what you can do (and not do).

What’s next? The lawsuit could result in one of the following outcomes by the end of the month:

  1. The judge could rule against us, and SB 423 becomes law on July 1st. If MTCIA has the funds available (donate today, please), we’d appeal.
  2. The judge rules totally in our favor, and SB 423 is struck down in its entirety. The state (we presume) would appeal such a decision.
  3. The judge could strike portions of SB 423 as unconstitutional, but allow the rest to become law on July 1st. Depending on the details, either or both sides could appeal.
  4. The judge could conclude that irreparable harm would occur if the law goes into effect, and also that the constitutional issues are important but complicated, and so order a delay of implementation of SB 423 for weeks or months.

We don’t know what will happen, but my personal opinion is that #4 is most likely. We’ll see. Cross your fingers.

Petition News

The Montana Attorney General’s office contacted Montana NORML today to let us know that they’d made some adjustments to the proposed petition language. This is an important step in the process, and we’re hopeful we could have the petition approved in its final format before the end of the month. We’ll see — they are allowed by law to take their time until July 5th.

In the meantime, a network of hundreds of volunteers statewide has been developing the systems required to gather the maximum number of valid signatures in all the right places, as quickly as possible. It’s a thing of beauty, watching a large group organize around a shared goal, pouring in their passions, talents, and free time.

Newsletter: Our new medical marijuana law: strategies and next steps

A few days ago I told you that the governor seemed to be pleased with SB 423, a bill that would demolish the legal cannabis industry in Montana and make it more difficult for patients to have safe and reliable access. Since I wrote those words, he has stated in no uncertain terms that he intends to allow the bill to become law. It is scheduled to become the new law of the land on July 1st.

Activist leaders across the state are mobilizing to stop SB 423 from becoming law. This involves multiple strategies:

  1. Persuade the governor to veto. He has said he will not, but we should keep pushing until he does. Read below for how to do so.
  2. File legal actions to block the law from taking effect based on constitutional objections. More on that front soon. If you know about such an effort, let me know so I can help coordinate. It could be really bad to have bunch of separate efforts! UPDATE 5/4/2011: Visit http://mtcia.org for info about how to donate to this effort!
  3. Collect signatures to block the law from taking effect and allow the voters of Montana to decide whether SB 423 is the right way to regulate medical marijuana.

Here are a few details on each effort:

1. Veto

This is a best case scenario. If the governor vetoes SB 423, we are left with the existing law — subject to any new administrative rules that the state provides, a function that has always been available to them, but they chose not to use. We need to pressure the governor to take this option — veto the bill, and create a regulatory infrastructure via administrative rules. He has the power to do this.

Tell him so:

  3. Call: (406) 444-3111 and urge the governor to veto SB 423 and
    regulate medical marijuana via administrative rules.
  4. Write a letter to the editor of your local paper. These messages matter!

  • Whitefish — Thursday May 5th, 11:30AM, Whitefish Performing Arts Center. The governor will be attending this event, and we would like to see a mass of people, dressed in their Sunday best, politely holding “VETO SB 423” signs. 2. Legal Action

It is possible that the right legal action, launched in the right jurisdiction, could prevent or delay implementation of SB 423.

My gut feeling is that there are probably 10+ big growers out there, with a bundle of cash and a top-shelf lawyer ready to do this — but, please, you guys, slow down, and consider this:

If multiple suits are launched in different jurisdictions that argue some of the same points, it’s possible that the suits could be combined to be heard in one court — which might be the worst court we could be in.

So, if you and your attorney are hot-to-trot to sue, please let us know so we can help coordinate the various efforts into one which is strategically and legally sound. We want to connect the experts into a team, so we can win.

3. Signatures

Montana law allows us the possibility of blocking an act of the legislature if we gather enough signatures. It’s a big number, something like 100,000 signatures.

If it comes to this, we will need to recruit 1000 signature gatherers. If you would like to volunteer to lead regional signature gathering, please email norml@montananorml.org and let us know — include your city and phone number and any special skills or resources you have (like a crew of 10 volunteers ready to help, for example). If you can pledge to gather 20 sigs, that counts! Let us know.

We cannot gather signatures yet. It is a legal process, which is unlikely to be complete before June. Sit tight, the delay is absolutely unavoidable.

There is a whirlwind of activity statewide to combat the new law. Please forward this message to your friends. Things are happening, and we’ll need your help to succeed. Let us know if you are part of a regional group that intends to be involved and we’ll help coordinate.

Newsletter: Medical Marijuana Repeal Hearing Friday Mar 11

Next Friday, the 11th, the Senate Judiciary Committee will hear testimony on HB 161, the callous effort to erase medical marijuana from the law books of Montana. Montana NORML and a statewide coalition of cannabis reform organizations are doing everything we can to get as many people to the hearing as we can. Now is the time to put aside the hectic tasks of your regular daily schedule and SHOW UP.

We are asking professional growers/caregivers to consider Friday the 11th a “holiday”: gather 20 patients and get thee to Helena. If you’re already in Helena, you have no excuse not to be there:

WHEN: March 11, 2011, 8:00am
WHAT: Senate hearing on medical marijuana repeal
WHO: You, in your Sunday best, polite and respectful.
WHY: Because your health, or your livelihood, or your principled philosophy, depends on keeping cannabis legal.

Don’t have a ride? No problem. Our friends at MRL are coordinating FREE buses from all over. Check out this page on Facebook for info on buses. Make a call, find a ride, make it happen. (For Billings, call James at 670-0143).

It’s important to show up because every person who shows up represents a hundred other people who didn’t bother. Be a leader!

It’s important to show up because while the repeal bill passed the Montana House easily, more “sober” minds rule the Senate, and when they see a massive outpouring of support for medical marijuana represented in our amassed crowd, they should acknowledge the political reality that legal cannabis is here to stay, and reject repeal in favor of thoughtful regulation.

Can’t make it? Is it just impossible? Then here are some other ways you can contact the committee and let them know that repeal of medical marijuana would be a disaster, politically, logistically, all around.

In a rush? Okay, here’s a quick and easy e-mail form. Let them know to “fix it, don’t nix it”. Just be sure to add your personal story so it doesn’t seem like too much of a form letter.

Montana NORML Newsletter – Good News on HB 33 and Other Local News

Earlier this morning in the House Judiciary Committee, HB 33, the any-amount-of-cannabis-metabolites-is-DUI bill, was tabled. This means it’s likely dead. Republicans and Democrats alike saw it as an overreaching of authority and science to charge people with DUI just because of some traces of chemicals in their urine.

Relish that news, as there may not be a lot more good news out of this legislative session. We’ll see.

Also, there’s a hearing tomorrow about SB 193:

This bill is interesting is that it attempts to “tighten up” the medical marijuana program with subtle tweaks, rather than dramatic re-invention.

Some if these tweaks include:

  • raises patient app fee to $150
  • requires  patients and caregivers to sign statement not to divert
  • two physicians required for minors
  • caregiver registration fee of $200
  • caregivers must be residents and submit fingerprints
  • caregivers may not have criminal records that include crimes of violence or felony drugs (unless more than 10 years ago)
  • automatic card revocation for diversion
  • increase to 2.5 oz possession limit
  • plants must be grown in enclosed locked facility
  • 2.5 oz every 14 days max sold per patient
  • caregiver must maintain records of those sales, available to cops on request
  • no public smoking allowed

Montana NORML Newsletter – Missoula Fundraiser, Legislature and the News

First, a heads up:  I’m headed out of town for a week. While I am gone, you might receive email updates from our friend and Montana NORML board member Cynthia Wolken. She’ll let you know if anything happens in the legislature that needs your immediate attention.

The legislature convened on Monday and marijuana-related bills are swirling like smoke in a hookah.  By our friend Kate‘s last count, there are now 24 separate bills (click for a summary).

Whatever happens, rest assured that our medical marijuana program (if it still exists) will be a lot different in a few months. For now, though, it just keeps growing and growing.

Two events this month that warrant your attention:

On Saturday, January 8th in Missoula, join Irvin Rosenfeld at Zoo Mountain Natural Care for a fundraiser and book-signing. Mr. Rosenfeld has received 300 joints a month from the federal government for the past 25+ years and is a remarkable advocate for legal access to cannabis. Here’s the Facebook event page.

Then, the big one:

On Saturday, January 15th in Missoula, please plan on attending a fundraiser to benefit Citizens for Responsible Crime Policy, Montana’s only 501c3 public education group devoted to raising awareness about marijuana policies. This event is co-sponsored by many cannabis-focused organizations, including Montana NORML. Facebook users, click here to read about the cannabis coalition that’s formed over the past few months.

It takes lots of time and talent and money to assemble a functional grassroots political apparatus capable of having an impact on the lawmaking process, and things are starting to come together.

There will be various events throughout the process in which you can be involved. The first is a book signing MMGA fundraiser with Irv Rosenfeld, one of a handful of federal medical marijuana patients, who gets a big aluminum tin of pre-rolled marijuana joints from the federal government every month. For free. Read that again. It’s true.

The event will take place at Zoo Mountain Natural Care in Missoula from 6-8PM next Saturday January 8th. Here’s the Facebook event page. I’ll be out of town on a much-needed vacation, but thank you to Zoo Mountain for hosting the event (check out the video on their site).
